A transcription of the Last Will & Testament of Edmund Shirley, as recorded in the Boone County, IN courthouse (Book H1, Page 77): Last Will and Testament of Edmund Shirley I, Edmund Shirley, of Boone county, in the State of Indiana, do hereby make and publish this my last will and testament, hereby rovoking and making void all former wills by me at any time made heretofore. Fir[st, ] that my daughter Avarina Amanda Malvina have all the household and Kitchen furniture which I am possessed of at my death. Also, that said daughter [have] possession of of all my Real Estate for one year from the first of the next March after my decease, free of rent. Also, that all my other personal property not heretofore herein named shall be sold by my executors at my decease, and the money equally divided among my children, viz: Presley, Embly P., Daniel, William Miletus, Doctor J, Bartlett, James S. and my daughter A. A. M. Swagert. Also, that all Real Estate of which I am possessed at my decease shall be sold by my Executors, (after the time aforesaid which my daughter, aforsaid is to have the use of it.) and the money equally divided amon[g] my children before named. And I hereby make and ordain my sons Daniel and William Shirley my executors of this my last will and testame[nt.] In witness whereof I hereunto set my hand and seal this 17th day of Septe[m]ber, 1886 (Sig) Signed, sealed and published (in.) presence of Joseph Hellon and H. Sapham State of Indiana, Boone County, I, [long blank space], Personally appeared before the Clerk of the Court of C[om]mon Pleas Court within and for the said country and State, Hamilton Sap[ham,] one of the subscribing witnesses to the last will and testament of Edmund Shirley, late of said county deceased, now (duly) filed for probate, and being duly sworn on his oath says that the said Edmund Shirley died on the [??] day of January, 1860, at said county, That said deceased was at the t[ime] of the execution of said last will and testament of sound mind and me[m]ory, and of lawful age to devise his property, and that he executed the same of his own free will and accord, and without any coercion or restraint wh[at]ever. And the said affiant further states that he saw the said testator Edmund Shirley, deceased, in his lifetime, sign his name to the foregoing will and heard him acknowledge the same to be his act and deed for the purposes therein specified: and that this affiant and Joseph Hellon, subscribed their names to said last will and testament as attesting witnesses thereto in the presence of said testator and in the presences of each other, this 4th day of Febrary, 1860, [space] H.
